Prescott Cleared of Sexual Assault Allegations
In a significant development, a Collin County judge has cleared NFL star Dak Prescott of all civil claims related to long-standing sexual assault allegations. This decision came months after the Dallas Police Department concluded there was insufficient evidence to support the accusations against the Dallas Cowboys quarterback.
The allegations, which date back to 2017, surfaced publicly this year when the accuser filed a report with the Dallas Police Department in March. Prior to involving the authorities, the accuser sought $100 million from Prescott, promising to keep the matter private in return for the payment. This demand was stated in a letter from the accuser’s attorney sent in January.
In response, Prescott took legal action on two fronts, launching both a civil lawsuit and a criminal report against the accuser. His legal team, led by Levi G. McCathern, maintained that the allegations were part of an orchestrated extortion effort. McCathern articulated their stance clearly: "The original lies by [the accuser], her team, and their recent failed attempt to sue him civilly are all just a continuation of their extortion plot against Dak."
Originally filed in Dallas County, the accuser’s lawsuit was withdrawn in April, only to reappear in Collin County. However, it faced a significant setback in June when Judge Angela Tucker dismissed the claims. McCathern remarked on the judicial outcome, saying, "As we knew they would, they found nothing in their extensive exploration of the facts that would support a criminal prosecution."
Prescott, for his part, expressed his confidence in his legal standing. Speaking publicly, the quarterback stated, "I know the truth, I'm confident in what we filed, very confident in what we filed." He maintained that the allegations had no merit: "Has nothing to do with it."
The legal saga has continued to unfold in civil court in Collin County, where Prescott’s lawsuit seeking over $1 million for alleged extortion remains active. Despite the legal battles, Prescott's focus remains on his professional career, as he enters the final season of a four-year, $160 million contract in 2024.
For Prescott and his legal team, the situation has broader implications beyond the courtroom. McCathern emphasized the negative impact such allegations can have on genuine survivors of sexual assault: "These ploys distract from the trauma of legitimate sexual assault survivors and undermine the progress that our society has made in supporting them."
Prescott's camp is adamant about his innocence and is resolute in pursuing justice against what they claim is an extortion attempt. "We are confident that at the end of law enforcement's investigation into the extortion case that they will find the accuser and her attorneys just as guilty as Dak is innocent," McCathern asserted. He further defended Prescott's character, highlighting Prescott's new role as a father: "Mr. Prescott -- a new father to a baby girl -- has great empathy for survivors of sexual assault."
In the statement released by his attorney, McCathern reiterated Prescott’s stance on the accusations: "To be clear, Mr. Prescott has never engaged in any nonconsensual, sexual conduct with anyone. Lies hurt. Especially, malicious lies. We will not allow the Defendant and her legal team to profit from this attempt to extort millions from Mr. Prescott."
The legal confrontation is set to continue, with a hearing scheduled for September to determine if further action against the accuser is warranted. Meanwhile, the accuser retains the option to refile her case in Dallas County after a motion for a "non-suit without prejudice" was filed, keeping the door open for potential future litigation.
